Standard International Limited Warranty - Propeller AeroPoint & DirtMate Hardware


Propeller Aero, Inc ("Propeller") warrants to the purchaser ("Purchaser") that the goods described in this warranty at “4 - Coverage” ("Product"), in addition to the any warranty provided for in Propeller’s standard Terms and Conditions, Propeller hereby provides an additional terms of warranty applicable to the Product.

  1. Extension of Warranty to Limited Persons

    This warranty extends to the original purchaser of the Product warranted under this warranty and to their related bodies corporate and affiliates. This warranty is non-transferable except by express written consent of Propeller. 

  2. Length of Warranty

    The warranty begins on the earlier of either(i) the date the Product is activated or (ii) 3 months from the date of purchase by the Purchaser as noted in the relevant purchase order document and continues for a period of one (1) year from that date (“Warranty Period”).

  3. Geographical Scope 

    This Warranty is applicable in countries where Propeller Aero sells the Product, subject to the terms and conditions outlined herein. Service availability and response times may vary from country to country.

  4. Coverage

    This warranty covers the hardware products listed below and each of its component parts in so far as there are any defects, malfunction or other failure, in the materials and workmanship in the Product when used under the circumstances it may be reasonably intended within a commercial industrial environment, and expressly includes the following:

AeroPoint - specific terms

(a)  GNSS functionality: Defects affecting the Product’s ability to acquire and process GNSS signals.
 

(b)  Wireless Networking: Defects affecting the Product’s Wi-Fi and Bluetooth connectivity.
 

(c)  Internal Components: Defects in the processor, memory, and other electronic components.
 

(d)  Ruggedization: Defects in the enclosure that compromise its ingress protection (AeroPoints are dust proof, and can tolerate moderate rain) under normal industrial use, excluding physical damage.
 

(e)  Battery: Defects in the Product’s battery that prevent it from charging or maintaining a charge according to specifications.
 

DirtMate - specific terms

(a)  GNSS functionality: Defects affecting the Product's ability to acquire and process GNSS signals.

(b)  Wireless Networking: Defects affecting the Product's HaLow, Wi-Fi, Bluetooth, and Cellular connectivity.

(c)  Internal Components: Defects in the processor, memory, and other electronic components.

(d)  Ruggedization: Defects in the enclosure that compromise its ingress protection (IP66 & IP68) under normal industrial use, excluding physical damage.

(e)  Battery: Defects in the Product's battery that prevent it from charging or maintaining a charge according to specifications.

 

5. Exclusions

This warranty does not cover the following:

(a) Damage resulting from:

     (I) Misuse, abuse, or neglect;

     (ii) Accidents, impact, or improper handling;

     (iii) Exposure to environmental conditions outside the product's specifications;

     (iv) Failure to follow operating instructions; and

     (v) Use with incompatible equipment.

(b)  Normal wear and tear, including cosmetic damage, scratches, and fading.

(c)  Unauthorized modification or repair of the Product.

(d)  Damage caused by external factors, including but not limited to:

     (I) Power surges or electrical faults;

     (ii) Extreme temperatures;

     (iii) Corrosion; and

     (iv) Natural disasters.

(e) Software issues not related to a manufacturing defect.

(f) Consumable parts or accessories.

 

6. Procedure for Obtaining Warranty Service

To obtain warranty service, the Purchaser must:

(a) Contact Propeller Aero support at hardwaresupport@propelleraer.com.au.

(b) Provide proof of purchase or purchase order documentation (e.g., original invoice) and the Product serial number.

(c) Obtain a Return Merchandise Authorization (RMA) number from Propeller Aero.

(d) Ship the Product to Propeller Aero's designated service center, with the RMA number clearly marked on the package. The Purchaser is responsible for shipping costs to the service center. Propeller Aero will cover return shipping costs for valid warranty claims.

 

7. Remedies

(a) Upon validation of a warranty claim, Propeller Aero will, at its sole discretion and without charge to the Purchaser, remedy by way of one of the following:

     (i) replace the Product with a new or refurbished product of equivalent functionality;

     (ii) repair the Product; or

     (iii) provide a refund of the original purchase price.

 

(b) However, Propeller will not elect to provide a refund unless it is unable to provide a replacement and repair is not commercially practicable and cannot be made within the time for performance.

(c) Any repaired or replaced Product will be covered for the remainder of the Warranty Period.

 

8. Dispute Resolution

The Consumer shall contact the Warrantor and seek by way of an informal dispute resolution procedure. The Consumer must undertake an informal procedure before pursuing any legal remedy in the courts.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROPELLER AERO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE PRODUCT.

10. Governing Law and Extraterritorial Considerations

This warranty shall be governed by the laws of Delaware, USA. However, the Purchaser shall note that in so far as this warranty gives you specific legal rights, and you may also have other rights which vary from State to State.

For any consumers in other countries - look to your local state or country regulations.
